Which sources and data do we use?

We process personal data (name, function, company and contact details such as e-mail address and telephone numbers) that we receive from you in your capacity as representative, authorized representative or contact person of the legal entity. In addition, we process personal data that we have obtained from publicly available sources (eg commercial and association registers, press, media, Internet) and are allowed to process.

We process personal data (name, address, e-mail address, telephone number) that we receive from our customers as part of our business relationship for the fulfillment of the contract.

What do we use to process your data and on what legal basis?

a) For the fulfillment of contractual obligations (Article 6 (1) (b) DSGVO)

The processing of personal data takes place in order to fulfill our performance obligations or to carry out pre-contractual measures towards our customers and suppliers.

The processing of personal data in the end customer business takes place to provide our performance obligations to our customers, primarily for notification, delivery and complaint processing.

b) In the context of the balance of interests (Article 6 (1) (f) DSGVO)

If necessary, we process your data beyond the actual performance of the contract, for example, for the exchange of data with credit bureaus and credit insurers to minimize the risk of default, for advertising and opinion polling, asserting legal claims and for video surveillance to safeguard the house.

c) On the basis of your consent (Art. 6 (1) a DSGVO)

Insofar as you have given us consent to the processing of personal data for specific purposes, the lawfulness of this processing is given. A given consent can be revoked at any time.

 

Who gets my data?

Within our organization, individuals and departments have access to the information they need to fulfill our contractual and legal obligations. Our service providers and vicarious agents also receive your data for this purpose. The prerequisite for this is compliance with the data protection agreements. We only pass on your data to processors if they contractually guarantee compliance with the DSGVO.

Is data transmitted to a third country or an international organization?

Data we receive to fulfill our contractual obligations will not be transmitted to third countries or international organizations. Data storage takes place exclusively on German or European servers.

How long will my data be stored?

Data which are no longer required for the performance of contractual obligations, or for the maintenance of the business relationship or in the interests of balancing interests, are deleted, unless their temporary processing is necessary for the following reasons:

1. Fulfillment of commercial and tax retention periods u. a. according to HGB and AO (10 years)

2. Preservation of evidence under the statute of limitations according to § 195 ff. BGB (regular 3 years, maximum 30 years)

Which data protection rights do I have?

Each data subject has the right to information (Article 15 DSGVO), correction (Article 16 DSGVO), cancellation (Article 17 DSGVO), limitation of processing (Article 18 DSGVO), opposition (Article 21 DSGVO) and data portability (Art. 20 DSGVO). With the right to information and cancellation the restrictions according to §§ 34, 35 BDSG apply. In addition, there is a right of appeal to a data protection supervisory authority (article 77 DSGVO in conjunction with section 19 BDSG.

You may revoke your consent to the processing of personal data at any time. The revocation works only for the future.

Is there a duty to provide data?

As part of our business or contractual relationship, you must provide the personal information necessary to enter into, conduct, and perform any contractual obligations. Without these data, we will reject the conclusion of the contract or the fulfillment of the contractual obligation, no longer have to perform an existing contract or terminate if necessary.

In particular, we require the following data for the shipment of our products: name, delivery address, telephone number and e-mail address. They serve the smooth course of our contractual delivery obligation.
